These Terms and Conditions (“Terms”) apply to your access and use of FOTO World, an
online platform for the curation and display of photographic art (“Platform”). By using or
accessing the Platform, you agree to be bound by these Terms as updated from time to
time in accordance with section titled “Modification of the Terms” listed below. The
owners and/or managers of the Platform may at times ask you to review and accept
supplemental terms that apply to your interaction with the Platform. Please read the
Term carefully before using or accessing the Platform.
1. Scope of Services. The Platform gives you the opportunity to have your artwork
curated and showcased in the Platform’s online gallery. The Platform does not
offer any other services beyond curation and display of art. The Platform’s
curators have full discretion in determining which art will be displayed through the
Platform.
2. No Legal Obligation.  The Platform, its owners, managers and/or curators have
no legal obligation to perform any marketing, sales or similar service for you or
on your behalf. Furthermore, the Platform, its owners, managers, and/or curators
have no legal liability to you for any outcomes related to the use of the Platform.
This includes, but is not limited to, the success of artwork curation, user
interactions, and any financial transactions. The Platform, its owners, managers
and/or curators are not liable for violation of copyright, trademark, patent, and
other intellectual property laws arising out of or related to you’re the submission
of your artwork through the Platform.
3. Warranty Disclaimer. The Platform is provided “as is” and on an “as available”
basis, without warranty or condition or any kind, either express or implied.
Although the Platform owners and managers seek to maintain the Platform as
accurate and well-functioning services, they cannot guarantee the continuous
operation of or access to the Platform, and there may at times be inadvertent
technical or factual errors or inaccuracies. Your use of the Platform is at your own
risk.
4. Third Party Content. The Platform may contain links to third party websites and
services.  The Platform provides such links as a convenience, and do not control
or endorse these websites and services.  You acknowledge and agree that the
Platform, its owners, managers and/or curators have not reviewed the content,
advertising, products, services, or other materials that appear on such third party
websites or services, and are not responsible for the legality, accuracy, or
appropriateness of any such content.
5. User Responsibilities. You are responsible for ensuring the originality and
legality of the artwork you submit through the Platform. You must own all content
you submit through the Platform. In addition, you agree not to use the Platform
(a) for any illegal purposes, or in violation of any local, state, national or
international law or (b) to copy, reproduce, republish, or publicly display any
materials available on the Platform other than your artwork without express
permission of the Platform owner or manager. To use the Platform, you must be
at least eighteen (18) years of age, or, if you are under 18 of age but at least
thirteen (13) years old, you must you the Platform with the consent of your parent
or legal guardian.
6. Content Rights. You hereby acknowledge and agree that by submitting your
artwork through the Platform, you expressly and affirmatively grant to the
Platform, its owners and managers, a non-exclusive, world-wide, transferable,
sublicensable, perpetual, irrevocable, and royalty-free license to display,
distribute and transmit the content underlying your artwork for the purpose of
developing the Platform. The foregoing license include, without limitation, the
express rights to: (i) display the art content on the Platform, a third party platform,
social media posts, blogs, virtual galleries, or to the public and (ii) host, store,
distribute, and reproduce one or more copies of such art content within a
distributed file keeping system, node cluster, or other database (e.g., IPFS) or
cause, direct, or solicit others to do so.
7. Termination of Use. If you violate these Terms, your permission to use the
Platform will automatically terminate. In addition, if you violate these Terms the
owners and/or managers of the Platform may in their own discretion suspend or
terminate your access to the Platform at any time with or without notice to you.
8. Modification of the Terms. The owners and/or managers of the Platform may
modify these Terms at any time by posting a newer version of the Terms on the
Platform. Continued use of the Platform after such changes constitutes
acceptance of the new terms.
9. Governing Law. These Terms shall be governed by the laws of the State of New
York. You agree to resolve any disputes related to or arising under these Terms
in small claims courts located in New York.
